1. Purpose and acceptance

These terms regulate access to and use of evolvemd.es, as well as information requests, quotes and services offered by EVOLVE MEDIA DIGITAL.
Using the website makes the visitor a user and implies acceptance of these terms where applicable.
A specific service will be governed by the proposal, quote, invoice, contract or written communication accepted by both parties.
If a particular condition contradicts this document, the particular condition accepted for that project will prevail.

2. Services offered

EVOLVE MEDIA DIGITAL manages digital projects: strategy, web design, SEO, advertising, social media, automations, analytics, applied AI, support and consultancy.
Published packs are mainly oriented to web presence, acquisition and recurring digital improvement, but may be adapted by sector, goal and maturity.
Custom services may include platforms, communities, integrations, ecommerce, internal systems, advanced campaigns or phased digital direction.
Website information is commercial and informative; it is not a closed contractual offer until expressly accepted.

3. Quotes, prices, taxes and payments

Prices visible on the website are indicative unless expressly stated otherwise or accepted in a quote.
Amounts may vary due to scope, number of pages, language, content, integrations, campaigns, external tools, urgency, maintenance or workload.
Applicable taxes, third-party expenses, domains, hosting, licenses, advertising investment or external tools will be indicated when relevant.
Starting work may require an initial payment, written acceptance, access delivery and scope validation.
Non-payment of due amounts may temporarily suspend deliveries, support, campaigns or recurring services until regularized.

4. Client obligations

The client must provide truthful information, materials, copy, images, access, permissions and approvals needed to execute the project.
The client declares they have sufficient rights over logos, photos, texts, databases, brands, products or content delivered for use.
Delays in materials, reviews or approvals may affect estimated deadlines without implying breach by EVOLVE MEDIA DIGITAL.
The client is responsible for reviewing deliverables, legal texts specific to their activity, prices, contact details and published information.

5. Deliveries, revisions and deadlines

Deadlines communicated are reasonable estimates and depend on scope, material availability, client feedback and technical load.
Included revisions will be detailed in the proposal. Out-of-scope changes may be quoted separately.
A delivery may be considered validated if the client approves it in writing, uses it publicly or does not report relevant issues within the agreed period.
EVOLVE MEDIA DIGITAL may propose phases to reduce risk: diagnosis, structure, design, development, measurement, launch and improvement.

6. Third-party tools

Some projects may depend on external services such as domains, hosting, ad platforms, CRM, email marketing, payment gateways, analytics, AI or plugins.
Third-party conditions, prices, availability, technical changes or incidents do not depend on EVOLVE MEDIA DIGITAL.
When external tools are required, it will be indicated who bears the cost and who owns the account.
Whenever possible, the client should keep ownership of domains, hosting and strategic accounts.

7. Intellectual property and deliverable use

Original client materials remain property of the client.
Designs, texts, structures, code, configurations, documents, campaigns or systems created for the client may be used according to the paid and accepted scope.
Until full payment of due amounts, EVOLVE MEDIA DIGITAL may limit final deliveries, editable file transfer or transfer of certain assets.
Unless otherwise stated in writing, EVOLVE MEDIA DIGITAL may mention the project as portfolio while respecting confidential information.

8. Reasonable guarantees and limitation of liability

EVOLVE MEDIA DIGITAL will work with professional diligence, reasonable technical criteria and tracking of agreed goals.
Specific search positions, exact sales volume, fixed number of leads, ad approval or exact advertising results are not guaranteed.
Results depend on market, offer, competition, budget, reputation, sales capacity, client response and external factors.
Liability will be limited, to the extent allowed by law, to amounts actually paid for the service that caused the claim.

9. Cancellation, withdrawal and personalized services

Recurring service cancellation must be communicated in writing under the conditions agreed in the proposal or contract.
Work already started, diagnostics, designs, configurations, campaigns, developments, consultancy or personalized services may be non-refundable if executed in whole or in part.
If the client acts as a consumer, their statutory consumer rights will be respected.
When the service consists of digital content, personalized services or immediate execution requested by the client, legal exceptions to withdrawal may apply.

10. Data protection, confidentiality and communications

Data provided will be processed to answer requests, prepare quotes, manage the contractual relationship, provide services and maintain necessary communications.
Both parties must keep confidential any business, technical, commercial or strategic information received during the project.
When EVOLVE MEDIA DIGITAL accesses personal data on behalf of the client, data-processing conditions will be formalized if necessary.
The client may exercise data protection rights by writing to the contact address indicated on the website.

11. Applicable law and dispute resolution

These terms are governed by Spanish law.
Before legal action, the parties will try to resolve any disagreement amicably and with documentation.
Where legally appropriate, the competent Spanish courts and tribunals will apply according to the nature of the client and the contractual relationship.
If any clause is declared void, the remaining clauses will remain valid to the extent allowed by law.
